General Terms
This document outlines the Terms and Conditions (hereinafter referred to as "Terms") governing the agreement between Make It Surf and the Client for the provision of web design and development services using no-code technology (and any other services agreed upon individually with the Client).
Acceptance of these Terms by the Client is a mandatory requirement for contracting the services offered by Make It Surf. By hiring Make It Surf’s services, the Client expressly acknowledges having read, understood, and fully accepted these Terms.
Services
These Terms describe the services that Make It Surf will provide to the Client, the responsibilities of both parties, payment conditions, intellectual property rights, liability limitations, and procedures for resolving disputes. Clients are advised to carefully review these Terms before hiring Make It Surf’s services. If the Client has any questions or concerns regarding these Terms, they should contact Make It Surf before accepting them. Hiring Make It Surf’s services implies full and unconditional acceptance of these Terms and Conditions.

Payments and Delivery Deadlines
Payment terms and delivery deadlines for each project will be individually agreed upon through a personalized quote and a written contract. The contract will detail the specific services to be provided, total cost, payment methods, payment schedules (which may include initial, partial, and final payments), and delivery timelines for each project phase.
Both payments and deadlines are fully customizable and tailored to the Client’s needs and capabilities. Make It Surf will notify the Client of any unforeseen delays in project delivery as early as possible, providing justification for the delay. Failure by the Client to comply with agreed payment terms may result in the suspension or termination of the project, as stipulated in the individual contract. Late payments may accrue interest according to applicable laws.
Confidentiality
Make It Surf is committed to maintaining the confidentiality of all information provided by the Client in connection with the website development process. This includes, but is not limited to, designs, content, marketing strategies, and business data. Such information will not be disclosed to third parties, except when required by law or with the Client’s explicit consent.
Liability
Make It Surf utilizes third-party no-code web development platforms to create websites. While Make It Surf strives to select reliable and high-quality platforms, it does not assume responsibility for service outages or failures beyond the terms stipulated by those third-party platforms.
Make It Surf’s liability is limited to the services agreed upon in the individual contract and excludes indirect, incidental, consequential, or punitive damages arising from the use of the developed website. The maximum liability for any claim related to the services provided will not exceed the total amount paid by the Client for the specific project in question. Make It Surf is not responsible for lost profits, business interruptions, or any indirect damages suffered by the Client. The Client agrees to hold Make It Surf harmless from any damages or losses resulting from misuse or lack of maintenance of the website by the Client.
Modification of Terms and Conditions
Make It Surf reserves the right to modify these Terms and Conditions at any time. In the case of substantial changes, Make It Surf will notify the Client at least 10 calendar days before the changes take effect via the email address provided by the Client. Changes will be deemed accepted by the Client if they do not notify Make It Surf of their objections in writing within the specified timeframe.
For ongoing projects with previously agreed-upon payments and commitments, any modification to these Terms affecting the price or scope of work will require a written agreement between Make It Surf and the Client prior to implementation. Failure to reach such an agreement will result in the continuation of services under the original Terms and Conditions. Clients are encouraged to periodically review these Terms to stay informed about updates.
